Welcome to Proseed New Zealand. These Terms and Conditions govern your use of our website and the purchase of products from Proseed. By accessing our website or placing an order, you agree to be bound by these Terms and Conditions.

1. Definitions

  • “Proseed”, “we”, “us”, or “our” refers to Proseed New Zealand Ltd.
  • “Customer”, “you”, or “your” refers to the individual or entity placing an order or using our website.
  • “Products” refers to tree seeds and related goods offered for sale by Proseed.

2. Ordering and Payment

  • Orders may be placed via post, fax, or email. Please use Latin names and specify seedlots where applicable.
  • All orders are subject to availability and confirmation.
  • Prices for Radiata pine are exclusive of GST; all other prices include GST.
  • Payment is due upon invoice unless otherwise agreed in writing.

3. Pricing and Royalties

  • Prices are listed in New Zealand Dollars (NZD) and are subject to change without notice.
  • Royalties are collected on behalf of the Radiata Pine Breeding Company (RPBC) and apply to all Radiata pine seed products.
  • Customers purchasing CP (Control Pollinated) seed must sign a declaration agreeing to RPBC’s conditions before seed is released.

4. Shipping and Delivery

  • Orders are dispatched as soon as possible unless otherwise instructed.
  • Shipping charges are additional to product prices and vary based on weight, delivery method, and destination.
  • Rural delivery surcharges apply.
  • International customers must contact us to confirm import conditions and shipping arrangements.

5. Returns and Refunds

  • Due to the nature of our products, returns are generally not accepted unless the product is defective or incorrect.
  • Claims must be made within 7 days of receipt.
  • Refunds or replacements are at Proseed’s discretion.

6. Use of Seeds and Restrictions

  • Seeds sold by Proseed are for planting purposes only.
  • Use of Radiata pine seed for breeding or vegetative propagation (e.g., cuttings) is prohibited without a propagation licence from RPBC.
  • Breeding information remains the property of RPBC and may not be used without written permission.

7. Intellectual Property

  • All content on this website, including text, graphics, logos, and images, is the property of Proseed or its licensors and is protected by copyright and other intellectual property laws.
  • You may not reproduce, distribute, or use any content without prior written consent.

8. Limitation of Liability

  • Proseed shall not be liable for any indirect, incidental, or consequential damages arising from the use of our products or website.
  • Our liability is limited to the purchase price of the product in question.

9. Governing Law

  • These Terms and Conditions are governed by the laws of New Zealand.
  • Any disputes shall be resolved in the courts of New Zealand.
